Statutory Rights

The following terms and conditions do not affect your statutory rights as a consumer.

Product Availability

It is important to note that information about our products does not amount to an offer by us to sell the products on that basis. Rather, it is an invitation to you to make us an offer to purchase that product on that basis, therefore references to 'orders' placed by customers are deemed to be references to offers by such customers to purchase the relevant produce from us. Although we will endeavour to maintain to supply you with the item requested, sometimes we may be unable to fulfil an order. In this instance, you will be informed at the earliest opportunity. Product images displayed on the website may occasionally differ from the respective product names and descriptions, due to changes in packaging and/or availability.

Price

The prices quoted throughout our website are inclusive of UK VAT at the current rate. We reserve the right to change our prices at any time. There may be occasions where prices are incorrectly quoted or change at short notice as a result of circumstances beyond our control. If this situation occurs you will be informed of the correct price by telephone or email as soon as possible and should you not wish to proceed, that part of your order will be cancelled. Please note that on occasions some colours or sizes in a particular style are at a different price to others. This happens when we have discontinued a colour/size and have therefore reduced the price.

Cancellations

If after golfposer.com has accepted an order from you (acceptance will be communicated via e-mail on receipt of an order), and you wish to withdraw from the contract, you may do so by communicating with us immediately. If an item has been shipped then we cannot cancel the order and you will be required to return the item as normal. If you have already received the goods and they are unwanted, you must return the goods to us at your own cost and risk. It is imperative that you notify us within 5 working days of receipt of goods. Provided the goods are returned in the same condition as we supplied them to you, we shall reimburse all monies paid by you for those goods.

Returns

Unsuitable items may be returned for refund or exchange providing they are received within 28 days of the original delivery date in brand new, unused condition (unworn and unwashed), in the original undamaged packaging (with labels intact) and accompanied by a note stating your name, address, email address, contact telephone number, order number, the reason for the return and what refund/exchange you require.

We will consider the overall condition of the product being returned when making a refund. Golfposer holds a limited amount of stock at any given time, therefore ill-fitting or unwanted goods should be returned as soon as possible.

As soon as we receive your goods we will process your request for a replacement item or refund as requested. We will notify you via email as soon as your request has been processed.

You will need to pay the cost of returning goods to us (unless the item has been received faulty*). When returning an item we advise you get a certificate of posting and sufficient insurance from the Post Office when you send an item back. For more expensive items we also advise that a fully insured service is used e.g. Recorded Delivery for items up to £35 and Special Delivery for items above £35.

All refunds are applied to the payment method used to make the original purchase. Refunds will be furnished within 2 days of the agreement to refund.

If you have requested a refund, or replacements of a lower value than the returned goods, a refund will be credited back to the card used to pay for the original order. We will let you know as soon as the refund has been processed.

If you have requested replacements of a higher value, any difference due will be charged to the card used to pay for the original order.

We reserve the right to deduct our postage costs incurred in the original order from the refund given. This will not apply to faulty goods.

If your goods are received faulty, we will require email notification of this within 7 days of receipt of the goods and we expect the faulty goods to remain unworn, with tags attached and in original packaging.

On goods we have specially ordered in at the request of a customer (goods we do not carry) we won't accept returns unless faulty. The only other occasion we would consider return is for exchange but the special order item would be subject to a handling and re-stocking charge.

Delivery

Golfposer.com will endeavour to deliver to you within the specified time. However, there may be instances when we cannot deliver within this time. If we realise that we cannot deliver to you within that time, we shall alert you as soon as possible to try to arrange another suitable time for delivery.

Data Protection

www.golfposer.com conforms to the UK Data Protection Act. Any information you provide is treated in strict confidence and is stored in a secure location. Customer’s details will not be disclosed in any way to any persons outwith www.golfposer.com. Termination

www.golfposer.com reserves the right to abort access of our internet services if your behaviour is found to be discordant with these terms and conditions at any time.

Intellectual Property

No permission is given by www.golfposer.com in respect of the reproduction or use for injurious or commercial purposes of any brand names, product names, designs and any other material shown on the www.golfposer.com website in which intellectual property rights subsist. ALL RIGHTS RESERVED.

Governing Law

Any use of the www.golfposer.com website and any purchase by the customer on this site will be governed by the Law of Scotland and will be deemed to have occurred in the UK and all parties shall submit to the exclusive jurisdiction of the Scottish Courts.
